The Japanese pharmaceutical company Jinguasin (manufacturer of Viagra) has been ordered to pay $4 billion to settle a lawsuit by the state of New Jersey alleging a lack of market oversight over the sale and distribution of its erectile dysfunction drug, Viagra, which has been sold without a license.
Japan’s drug maker Jinguasin says the settlement resolves allegations that the company is “alleging that the company’s license to sell sildenafil and other impotence drugs is insufficient.”
In a statement, the company said in part: “The case was brought by state-owned Japanese companies.”
The lawsuit was filed in New Jersey District Court, in New Jersey state court, in the first case to be settled since the merger of the pharmaceutical companies in 1995.
Viagra is the brand-name drug used for male sexual health. In February 2013, the company, which sells the drug, voluntarily recalled the drug for a “dangerous interaction” with an interaction that was not disclosed to the U. S. Food and Drug Administration. It was the second recall to be approved by the FDA.
A spokesman for the state attorney general’s office said in a statement, “We are unable to comment further on the nature of the matter in any way.”
Jinguasin was formed by former employees of Eli Lilly and Co. and Mylan Pharmaceuticals, the maker of the drug, to sell the impotence drug under the brand name Revatio, and Jinguasin’s other brand names, including Revatio, Revatio-C, and Revatio-T.
The lawsuit, which was filed in the Eastern District of New York in New York state, alleges that Jinguasin “engaged in the practice of encouraging the use of a drug which was not approved by the FDA” without adequate warnings and without the supervision of the FDA.
Jinguasin was accused in federal court of illegally promoting and selling the drug. In a letter to the company’s U. Attorney, Mr. Mark C. Seiden, the company said it was “disrespecting the facts” in the case because it “could not have known of any risk to its public health or safety.”
The company said that it has obtained approval from the FDA for the sale of Revatio and Revatio-C at locations around the country. It said it would seek FDA approval before selling the drug for the market.
“It was a violation of the law when it was alleged that the company engaged in a practice that was not approved by the FDA,” Mr. C. Seiden wrote in a letter to the company.
The company said it will contact the FDA to determine whether to take action against it.
Last year, the company said it had received a letter from the FDA warning of a possible increased risk of heart attack and stroke and had asked for a letter of warning from the FDA to address the issue.
Jinguasin and other pharmaceutical companies are accused of failing to warn the public about the dangers of erectile dysfunction drug sales. They say the drug, which has a low rate of side effects and risks, is “inadequately evaluated by health care providers,” and that it “is not likely to be effective for long-term use.”
The lawsuit says that the company had “several” prior FDA warnings about the drug’s heart risks and the dangers of heart attack and stroke, but that the company “has never approved or sponsored the use of sildenafil or any other erectile dysfunction drug.”
The company’s U. Attorney’s Office said in a statement, “If you find it is in your best interest to seek FDA approval to sell a drug, it would be best for your health to seek the approval of the FDA.
“Consult with your healthcare professional if you find yourself in the future seeking FDA approval for the sale of sildenafil, or other erectile dysfunction drugs, including Revatio-C or other impotence drugs, and you are concerned about the safety or effectiveness of the drug.”
The company declined to say how much it has agreed to pay.
In a statement, the company said in part, “The company is committed to providing all appropriate guidance, regulatory approval and support to our stakeholders in the areas of drug safety, regulatory approvals, and support for the development of effective, safe and effective products.

The drug, approved for use in adults and children over the age of 18, has been linked to a potentially life-threatening condition called "poison-filled hemophilia."
The drug is the active ingredient in the Pfizer drug Revatio, which treats the condition by relaxing blood vessels and increasing oxygen levels in the lung and blood vessels of the lungs.
Viagra, sold by Pfizer Inc., was originally developed to lower blood pressure to help treat hypertension, but doctors initially thought the drug could lower heart pressure.
The drug was originally developed as a heart medication. It was later approved for use in the treatment of erectile dysfunction, a condition where the heart is unable to pump enough blood to get an erection.
A doctor diagnosed Viagra users with "poison-filled hemophilia" and prescribed the medication. Viagra was then prescribed to patients for treatment of these conditions because the drug was believed to decrease the size of plaque in the lungs and decrease the likelihood of heart attacks, according to the FDA.
Viagra has been linked to the death of more than 5,000 people in the United States and is being used to treat the condition in the United States as well.
Originally developed to treat an enlarged prostate, it is now approved to treat urinary symptoms, such as difficulty urinating, and to treat high blood pressure in the blood vessels of the lungs.
